Can we take the tax-deduction for our neighbor's son?

We have cared for him well over 9 months (accumulated) and more often than not, are the primary source of his nutritional and diaperal needs. His mother will undoubtedly use him as a tax deduction, but WE have spent more time, effort and money on him than she has.

How can we justify adding him as a deduction to our 1040?

Unfortunately, you can't claim a dependent unless they are related to you and/or they live in your house, or they are a dependent parent (in some cases).

However, you may be able to claim all of the monies spent on him as charitable donations. You'll need to total up everything you have proof for, and see if is enough (under a certain amount and charitable donations don't really count).

Just a note--you may or may not want to verify this opinion with the IRS or someone at H&R Block, as the IRS may not also consider this a charitable donation. If the amount were too high they may look into it.

Additional sidenote--if there is a real problem with his mother, you may look into taking him into your home on a full time basis. This would not only give you the dependent to claim on your taxes but would have long term benefits for both you and the child Smile

Taking care of your neighbors child is not considered a charitable donation for tax purposes. My son had a friend who practically lived with me last year. (He was here more than he was at his own house) I sure wish I could have claimed him. Frown
