Last year I had some problems and I never received 2 of my W2's, I called my former employer over and over and never got them, eventually I got a new job, moved and just never ended up filing.

This year has rolled around and I havent filed yet either because I wasnt sure what to do about last year.

I dont owe any moeny, I will be getting money back, but I need to get this situated and am not sure where to start, expecially because im missing W2's and what not.

Any help would be appreciated. Thanks.

I'm Canajun, but |I'm sure the same principles apply.

Take whatever W2's you have. Estimate your gross earnings from the employers who failed to provide them. You can check your old bank statements for deposits, or just take your average weekly earnings and multiply by the number of weeks.

Then write a letter that says something like this:

In 2005 I did not file a return because two employers failed to send me a W2, in spite of my repeated requests.

The two employers are:
- ABX MANAGEMENT CONSULTANTS 123 Front St. Cleveland, and
- XYZ GIZMO MANUFACTURING INC, 890 Back St. Cleveland.

That is why I am filing late. I have estimated my earnings from those employers as best I can.

Sign it and put your ss # on it and file it attached to your 2005 return in the same envelope as your 2006 return. You can get a blank 2005 return from your local IRS office or (in Canada, at least) from the post office.

Don't delay. In Canada, if you wait until the third year, you lose your refund. Eek

The IRS can provide you with the missing W2 forms.

Click here for Form W-2.

There is no penalty for failure to file a tax return if a refund is due. You do have a 3 year deadline.
