If both of these would happen to die during office then who would become President? And who ever does will they keep the office until another election year or until we vote a new one in? Then who is vice president? This is so confusing... ++++++++++++ 07-03-03, 01:47 AM Dwight The 25th Amendment reiterates what is stated in Article 2, Section 1: that the Vice President is the direct successor of the President. He or she will become President if the President cannot serve for whatever reason. The 25th also provides for a President who is temporarily disabled, such as if the President has a surgical procedure or if he or she become mentally unstable.
The original Constitution provides that if neither the President nor Vice President can serve, the Congress shall provide law stating who is next in line. Currently that law exists as 3 USC 19, a section of the U.S. Code. This law was established as part of the Presidential Succession Act of 1947. There, the following line of succession is provided:
Speaker of the House of Representatives President Pro Tempore of the Senate Secretary of State Secretary of the Treasury Secretary of Defense Attorney General Secretary of the Interior Secretary of Agriculture Secretary of Commerce Secretary of Labor Secretary of Health and Human Services Secretary of Housing and Urban Development Secretary of Transportation Secretary of Energy Secretary of Education Secretary of Veterans Affairs Secretary of Homeland Security (not yet set by law)

07-03-03, 12:44 PM Texan-In-Exile Wait a minute Sammy - you're not confused enough yet! Wink
We did have a President and Vice-President who were never elected to those offices! In 1973, VP Spiro Agnew resigned and Pres. Richard Nixon appointed Rep. Gerald Ford as VP. In 1974, Pres. Nixon resigned, Ford moved up to Pres., and chose Nelson Rockefeller to be vP!
So...Ford & Rockefeller were our Pres. & VP, but weren't elected! Big Grin

07-04-03, 09:07 AM NCcichlid Texan-in-exile, you have given the answer to one of my favorite trivia questions.
"Who was Gerald Ford's Vice President?"
Many say Spiro Agnew when the correct answer is Nelson Rockerfeller.
There is a current attempt to change the US code 3 USC 19, established as part of the Presidential Succession Act of 1947. The change would move the Secretary of Homeland Security to 8th in line of succession.
