I see you remembered the previous question, a very similar one. The first income tax was levied in 1861, but was later declared unconstitutional by the Supreme court. I need to check to see when it was declared invalid.

I believe it was actually first levied by congress in 1862, when it was supposed to be a temporary source of funds for the Civil War...

It was then repealed in 1872, reinstated in 1894, and declared unconstitutional in 1895. The 16th ammendment then gave Congress the authority to tax income in 1913.

Our Constitution, Section 9 reads......"No direct Tax shall be laid". This has NEVER been repealed. IT IS STILL LAW. This renders the 16th Amendment invalid. You cannot have two opposing statutes in the Constitution. The Income Tax is a Constitutional violation, if enforced by the IRS. Only if the tax is voluntary, can it be Constitutional.

1) What exactly do you think an amendment is? No one is going to go in with a big red marker and cross out the line. That's not the way it works. The way changing the Constitution works is adding an amendment, not deleting a line. For the same reason, the constitution (article 2, section 3) still has the 3/5ths clause despite the 14th Amendment's removal of the system (one of many examples).

2) It's just a trivia question, not a debate on costitutionality. Lighten up.

Methos, thanks for the correct answer, and the explanation of the purpose here.

For the record, the exact wording is this:
Sec. 9....
No capitation, or other direct, tax shall be laid, unless in proportion to the census or enumeration herein before directed to be taken.
Of course, Section 8 says:
Section 8. The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States;

And the 16th Amendment, which, being the latest word on the subject, amends, or changes the Constitution, says:

Amendment XVI
The Congress shall have power to lay and collect taxes on incomes, from whatever source derived, without apportionment among the several states, and without regard to any census or enumeration.

And, further, for the record, this is a Trivia Forum. Any discussion other than that should be addressed in the appropriate Forum.
