landlord claims that 6 months ago 3 months worth of my rent payments were returned. I received a ledger from the landlord showing that the months in question were paid then 6 months later they were coded as not paid. I asked why the ledger did not show the exact date the payments were returned and the landlord said that it didn't matter. Do I not have a right to this information? What if someone typed in an invalid payment return by mistake?

What do I have the right to ask of landlord to help solve this dispute?

Does the landlord carry any burden of proof?

When the landlord says "returned", does he mean the checks bounced? If so, then you would have been aware of the returns at the same time he was!

Do you have receipts? Or, if checks were written, get copies of the cancelled checks. Even if you use Money Orders, as long as you have the receipts you can send away for copies of the deposited money order. It takes a little while and may cost a nominal fee, but would be worth it.

The whole thing sounds very fishy - that three months payments weren't credited 6 months ago and he's just now bringing it to your attention? Eek

If YOU have proof of the payments made, you should have no problem disputing this. Just be careful to keep copies of EVERYTHING.
