This is urgent and last minute, I know, but can anyone tell me what, if anything, the New York State health code says about used mattresses? I checked here and here but it’s not really clear to me.
The situation is: I have a defective mattress and the store that sold it to me is coming to pick it up to be repaired, and is leaving me an interim mattress (never mind the hassle I had to go through to get any of this accomplished). Do they have to leave me a new mattress, or some confirmation that it has been sanitized, or can they just give me any old mattress they have lying around?

This is happening tomorrow (8/26) and I was kind of assuming we would get a new mattress, but they didn’t say that specifically and it really wouldn’t make sense for them to give me a new mattress and lose money on that –but I’m not just letting them bring any old mattress into my house without some sort of verification that it is clean and sanitized...

Does anyone know the law, in plain English?

I don’t know the law, but unless the mattress was documented either as new or sanitized I would not allow it into my home regardless of what the law says.

Instead of repairing your new matress, they should just simply replace it.

Duh. Wink Unfortunately, the representative from King Koil refuses to return my phone calls, so I could not determine their logic in wanting to pay to ship and repair the mattress instead of just replacing it.

The delivery guys did show up on Tuesday as planned with a plastic-wrapped loaner mattress, complete with paperwork. Thankfully. Of course, the warranty guy gave them an incorrect number for my office so luckily my husband happened to be home when they showed up unannounced... But that's par for the course with these guys.
