Finally Jose Padilla, a U.S. Citizen who has been held with out charges for 3 years is being indicted by a federal grand jury. Now imagine if he is found innocent, and he would have spent so many years in prison for no reason, and what normally our constitution would prevent, was exploited by the administration through some loophole in the law. Scotty, you are screaming about the technicallity that Libby is being prosecuted on, why aren't you screaming bloody murder about a U.S. Citizen being held captive without a trial???
Well finally it looks like he will get a trial. If he is convicted, I sure hope he goes to jail for a long long time (I'm not a fan of the death penalty), but I can't help but wonder, what took so long, did they just now come to their senses? Is this a move by the bush administration to try and revive his ratings?
well it looks like he is facing life in prison, but the trial isn't set for almost another year, I suppose he's already been held for 3 years, what's another 1 year?
Ogi ************************************************************* 11-22-05, 06:39 PM honilov If he's guilty, he deseves whatever punishment he gets, but holding someone 3 years without charges is rather bizarre. ************************************************************* 11-22-05, 07:11 PM Rakuchild "Double" and "triple hearsay"? Is that like "a friend of a friend's cousin said"? Holding someone for 3 years without charges is not correct.
If the guy is guilty, I hope he is punished but to sit for 3 years wondering what you're going to have to defend yourself on if you ever see a judge...I'd be angry and probably a bit crazy.
Good luck on getting a fair trial, Jose! ************************************************************* 11-22-05, 07:28 PM DorianGreyed What is scary is that Padilla, a citizen of the United States, was arrested in Chicago, which is in Illinois, one of the United States. Thanks to the Patriot Act, the constitutional rights we once had are now subject to the whim of the president, and sometimes, just a prosecutor.
Apparently, the 6th Amendment to the United States Constitution means nothing.
VI - In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.
Where are the Libertarians in AnswerPool? ************************************************************* 11-22-05, 07:42 PM aminator2002 It's insane. Try the man or the Constitution may as well be used as toilet paper. ************************************************************* 11-22-05, 09:28 PM Ogi what caught my attention is that he was picked up and detained for planning to make a dirty bomb, but he isn't being charged with that!!! he is being charged w/ some other random bull ****, meaning they don't have **** on him.
I hope his lawyers counter sue the administration, that would revive some dignity in what this country stands for

Ogi ************************************************************* 12-22-05, 01:57 AM Ogi well another step of this process has played out:
quote: WASHINGTON, Dec. 21 - A federal appeals court delivered a stunning rebuke to the Bush administration today, refusing to allow the transfer of Jose Padilla from military custody to civilian law enforcement authorities to face terrorism charges in criminal court.
In denying the administration's request, the three-judge panel also said in a strongly worded opinion that the Justice Department's attempt to transfer Mr. Padilla gave the appearance that the government was trying to manipulate the court system to prevent the Supreme Court from reviewing the case. The judges warned that the administration might be jeopardizing its credibility before the courts in terrorism cases.
quote:
But the judges were clearly angered when the Bush administration suddenly shifted course on Nov. 22, saying it no longer needed that authority because it had decided to try Mr. Padilla in a civilian court. The government said that as a result of the shift, it was no longer necessary for the Supreme Court to review the issue of whether Mr. Bush could detain an American citizen indefinitely as an enemy combatant. Many legal analysts interpreted the sudden change in approach as an effort to avoid a Supreme Court review of the Fourth Circuit ruling.
well it appears that some other branches of government are getting frustrated by this administrations bypassing of the checks and balances system.
