Section 1, No. 4 No person except a natural born Citizen, or a Citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty-five years, and been fourteen years a resident within the United States. ****************************************** Schwarzenegger is not a "natural born Citizen:, and thus, is not eligible for the Presidency under current law. There would have to be an amendment to the Constitution in order for him to be eligible. ****************************************** Constitution of the United States
Article V
The Congress, whenever two-thirds of both houses shall deem it necessary, shall propose amendments to this constitution, or on the application of the legislatures of two-thirds of the several states, shall call a convention for proposing amendments, which , in either case, shall be valid to all intents and purposes, as part of this constitution, when ratified by the legislatures of three-fourths of the several states, or by conventions in three-fourths thereof, as the one or the other mode of ratification may be proposed by the Congress: Provided, that no amendment which may be made prior to the year 1808, shall in any manner affect the first and fourth clauses in the ninth section of the first article; and that no state, without its consent, shall be deprived of its equal suffrage in the Senate. ******************************************* It is highly unlikely that such an amendment could be enacted in time for the 2008 election; there simply isn't enough time. It's my opinion that no such amendment will be enacted in the foreseeable future.
I think the point is moot regarding Schwarzenegger. You are right that many people are calling him "a Democrat in Republican's clothing." Unfortunately for Arnold, a great many of them are Republicans.
